| Bankruptcy Q&A. Answers to frequently asked questions. What is Bankruptcy? The term "Bankruptcy" generally refers to the United States Bankruptcy law. The Bankruptcy law is intended to help and protect persons (and businesses) in financial difficulty and to provide an opportunity for a fresh start, free from unsecured debt. What does filing a Bankruptcy mean? When someone says they have "filed a Bankruptcy" they usually mean that they have filed a Bankruptcy petition (or "case") with the Court. A Bankruptcy petition sets out all the property and all of the debtor's debts and asks the Court for relief from debt as permitted under the Bankruptcy law. Will I lose any of my property if I file a Bankruptcy? Although the law requires complete disclosure to the Court of all assets and debts, the law also provides exemptions that allow the debtor to keep equity in certain types of property. Because of these exemptions, in the vast majority of cases, Bankruptcy does not result in the loss of any of the debtor's property. The ability to keep property is an important consideration - it is also an issue that can (and should be) determined with great accuracy before a case is even filed. |
